1. Acceptance of Terms

Welcome to SettleSmart. These Terms of Service govern your access to and use of the SettleSmart mobile application and website. By creating an account, accessing, or using SettleSmart, you agree to be bound by these Terms. If you do not agree with these Terms, you should not use the service.

2. About SettleSmart

SettleSmart is an expense management application designed to help individuals and groups record shared expenses, organize group spending, calculate balances, and identify suggested settlements between group members.

SettleSmart is a financial record-keeping and calculation tool. It does not provide banking, lending, investment, insurance, financial advisory, or money transfer services.

SettleSmart does not hold, receive, transmit, or transfer money on behalf of users and does not execute payments between users.

3. Account Registration

Certain features of SettleSmart require you to create an account. You agree to provide accurate and current information when creating and maintaining your account.

  • Keep your account credentials confidential.
  • Use your account only for lawful purposes.
  • Notify us if you believe your account has been accessed without authorization.
  • Provide accurate information and update it when necessary.

You are responsible for activity performed through your account unless the activity resulted from unauthorized access that was not caused by your failure to protect your account credentials.

4. Using SettleSmart

Subject to these Terms, you may use SettleSmart to:

  • Create and manage expense groups.
  • Invite and manage group members.
  • Add and organize shared expenses.
  • Record expense amounts, dates, descriptions, currencies, and participants.
  • View balances between group members.
  • View settlement suggestions generated from recorded expenses.

You must not use SettleSmart to:

  • Break applicable laws or regulations.
  • Access another person's account without authorization.
  • Attempt to gain unauthorized access to our systems or services.
  • Interfere with, disrupt, or damage the service.
  • Upload malicious software, harmful code, or other destructive content.
  • Use the service to impersonate another person or entity.
  • Abuse invitations, groups, or other features.

5. User-Generated Content

SettleSmart allows users to enter and store information such as expense descriptions, amounts, dates, currencies, group information, participant information, notes, and other content associated with expenses and groups.

You are responsible for ensuring that information you submit is accurate, lawful, and appropriate. You should not submit sensitive personal information that is unnecessary for using SettleSmart.

Information added to a shared group may be visible to other members of that group. You are responsible for considering what information you choose to share with other group members.

6. Expenses, Balances, and Settlement Calculations

SettleSmart calculates balances and settlement suggestions using information entered by users. Calculations are provided as a convenience to help users understand shared expenses.

You are responsible for reviewing expense information and confirming that amounts, participants, dates, currencies, and other details are correct.

SettleSmart may support expenses in different currencies. Currency-specific amounts and balances are intended to remain associated with their respective currencies and should not be interpreted as converted amounts unless a conversion is explicitly provided by the service.

Settlement suggestions do not constitute payment instructions, financial advice, or a guarantee that a payment will occur.

SettleSmart is not responsible for disputes between users, incorrect expense information, currency information entered incorrectly by users, or payments that users choose to make outside the service.

7. Account Security

We use reasonable security measures designed to protect user accounts and information, including secure connections, authentication controls, password recovery mechanisms, and optional two-factor authentication where available.

No internet-based service can guarantee absolute security. You are responsible for maintaining the security of your account credentials and devices.

8. Privacy

Your use of SettleSmart is also subject to our Privacy Policy, which explains what information we collect, how we use it, how it is protected, and the choices available to you.

9. Account Deletion

You may permanently delete your SettleSmart account using the account deletion functionality provided by the service, where available.

When an account is permanently deleted, the account record and associated personal information stored in the account are deleted from our active systems, subject to any information that we are legally required or otherwise permitted to retain.

Deleting your account may permanently remove your access to groups, expenses, balances, profile information, and other account-related data. Account deletion cannot necessarily be reversed.

10. Service Availability

We aim to provide a reliable service, but SettleSmart may occasionally be unavailable because of maintenance, updates, technical problems, network failures, third-party service interruptions, or circumstances outside our reasonable control.

We do not guarantee that the service will always be available, uninterrupted, secure, or error-free.

11. Intellectual Property

SettleSmart and its associated software, branding, logos, designs, text, graphics, and other original content are owned by SettleSmart or its licensors and are protected by applicable intellectual property laws.

These Terms do not grant you ownership of any SettleSmart intellectual property.

12. Suspension and Termination

We may suspend or terminate access to SettleSmart where reasonably necessary, including when an account violates these Terms, presents a security risk, involves unlawful activity, or is used to abuse or disrupt the service.

You may stop using SettleSmart at any time and may permanently delete your account as described above.

13. Disclaimer

SettleSmart is provided as a general expense tracking and calculation tool. Information, balances, calculations, and settlement suggestions generated by the service are provided for informational and organizational purposes only.

SettleSmart does not provide financial, investment, tax, legal, banking, or payment advice. You are responsible for independently verifying information before making financial decisions or payments.

14. Limitation of Liability

To the extent permitted by applicable law, SettleSmart is not responsible for losses arising from inaccurate information entered by users, disagreements between users, payments made outside SettleSmart, service interruptions, unauthorized access caused by circumstances outside our reasonable control, or misuse of the service.

Nothing in these Terms excludes or limits any liability, guarantee, or consumer right that cannot legally be excluded or limited under applicable law.

15. Changes to These Terms

We may update these Terms of Service from time to time to reflect changes to SettleSmart, legal requirements, security requirements, or our practices. Updated Terms will be published on this page with a revised effective date.

Your continued use of SettleSmart after an updated version becomes effective constitutes acceptance of the updated Terms, to the extent permitted by law.
